BAH Backpay Issue
Question about a possible back payment of BAH. I recently got out of the Marine Corps after serving about 4 1/2 years active duty. Before I enlisted, I had two children out of wedlock. Since their birth, well before my enlistment, I have been supporting them and they have lived with me. When I got to MCT, I realized that I hadn't been receiving any BAH/BAS/FSA. I tried to bring it up to one of the instructors, but it never got addressed. Upon arriving at MOS school, I again brought up the issue, and was granted BAH-diff, which I didn't realize at the time was any different. When I got to my PDS and found out that there was a difference, I began trying to get the full BAH rate. Because I was a single male parent, there were many hoops I had to jump through to get my BAH, but finally I did. However when I did get it, it was not backdated to my arrival date at boot camp, only to the date that I started pursuing the issue at my PDS. Throughout the years, I regularly tried to find out why this was and what I needed to do to get it fixed. I was often told, it's not gonna happen, stop trying. When it came time to separate, the question was raised to me by a Separations Marine about why things went like that. After explaining I was told that if I could get documentation proving custody for all that time, I could get the full rate back dated to boot camp. I ended up having to take the mother of my children, now my ex-wife, to court to try and get the documentation. In the end we got a custody agreement drawn up that stated my sole physical custody of the children since before I went to boot, which is what I was asked for. Now after turning in this paperwork to the admin section, I am being told that Marines are unable to collect BAH/BAS/FSA while in training of any kind (boot, MCT, MOS) and that I could only get it backdated to my date of arrival at my PDS. I know people who received all of this while in training and I'm now looking for some clarification/documentation proving either way only I'm not sure where to look.
